2025 USPTO Fee Changes: What You Need to Know to Protect Your Brand

Every two years, the USPTO reviews its fees, costs, and revenues, and this cycle brings significant changes to fees effective January 2025. Now is the perfect time to revisit your trademark and patent strategy. Here’s what you need to know:
1. Trademark Fee Changes: Starting January 18, 2025, the USPTO will adjust 28 trademark fees, including the consolidation of application types into a single base application fee with potential additional charges based on application complexity.
2. Patent Fee Adjustments: Effective January 19, 2025, the USPTO will implement a general fee increase of approximately 7.5% across most patent-related services. Notably, fees for filing, search, and examination of utility patent applications will rise from approximately 10% (from 1,820to2,000).
3. Introduction of New Fees for Continuing Applications: Effective January 19, 2025, the USPTO is increasing its existing fees and introducing many new fees to help address the growing number of continuation applications, via Regulation Identifier Number (RIN) 0651-AD64 (New Fee Rules). There will be additional fees for applications filed more than six or nine years after their earliest benefit date. Specifically, a 2,700feewillapplyforthosefiledaftersixyears,anda4,000 fee for those after nine years.
